A supporter of birthright citizenship and the Constitution outside the US Supreme Court (ACLU)
I joined Dublin NewsTalk on Wednesday morning to discuss the 6-3 decision of the US Supreme Court to uphold birthright citizenship.
I explain how the majority protected citizenship for those born in the US with non-citizen parents, a right stemming from centuries of English common law and reinforced by the Constitution’s 14th Amendment in 1868.
I note that while the justices maintained the legal barrier to the Trump camp’s assault on immigrants, refugees, and asylum seekers, two of the dissenters — Samuel Alito and Clarence Thomas — invoked political assertions in an effort to overturn the rights.
And I use facts to take apart the pretext of “birth tourism” used by the Trumpists in their citizenship.
