The House select committee on the Capitol Attack sets out potential criminal charges against Donald Trump.

The committee said on Wednesday that there is enough evidence showing Trump and his allies conspired to commit fraud and obstruction, misleading Americans about the November 2020 election and trying to overturn the victory of Joe Biden.

Committee lawyers set out the case in a court filing in a civil case in California. They attacked the judge to review the evidence behind closed doors.

The material includes more than 550 interviews including testimony from state officials, Justice Department officials, and senior Trump aides.

Douglas Letter, the general counsel of the House, summarized in the filing that the evidence “provides, at minimum, a good-faith basis for concluding that President Trump has violated” the law against obstruction: “The select committee also has a good-faith basis for concluding that the President and members of his campaign engaged in a criminal conspiracy to defraud the United States.”

The Committee attorneys filed in response to a lawsuit by Trump lawyer John Eastman, who set out the scheme for Vice President Mike Pence to block the Congressional certification of President-elect Biden’s victory in the Electoral College.

Pence, chairing the session, refused to exceed his Constitutional authority. Hours later, Trump supporters invaded the Capitol to stop the certification.

Eastman is asking a judge to block the House committee’s subpoena for documents in his possession.

The committee lawyers noted that Judge Amit P. Mehta of the Federal District Court found that it was “plausible to believe that the president entered into a conspiracy with the rioters on Jan. 6, 2021″.

In addition to the legal effort to delay the certification, there is also evidence that the conspiracy extended to the rioters engaged in acts of violence at the Capitol.
